Fire Fighter Termination Grievance

Arbitrator Rules in Favor of Firefighter Over Wrongful Termination

November 16, 2007 - An Award in favor of a Norman Firefighter by Arbitrator Otis H. King states, "Having found the City of Norman did not have just cause for the dismissal of the Grievant, the grievance is sustained. The Grievant is to be restored to his position as a permanent employee with back pay, seniority and all other benefits to which he would have been entitled had he not been terminated." May 24, 2007 - An Arbitration date has been assigned to hear the Grievance for the termination of firefighter Shannon Smith for September 11, 2007 at 9:30 a.m.

December 26, 2006 - Step #3 of this Grievance process has been forwarded to the Interim City Manager. (Read Step #3 Grievance Memo...)

December 20 - 2006 - A memo was received by the IAFF from the Fire Chief which has denied the grievance filed by Shanon Smith in this case. (Read Response...)

December 12, 2006 - This Grievance was filed on behalf of Firefighter Shannon Smith for being terminated without cause.

On December the 9th Shannon Smith was contacted by mail sent through Fedex stating that he was terminated as of that day and he was to turn in all of his City property. Shannon’s probationary period ended on December the 5th and Shannon has received satisfactory evaluations on his job performance during his first year. This action violates the Collective bargaining agreement. (Read Grievance...)
